Hiring a Real Estate Attorney

In real estate, the truth is that many things have the potential to go wrong. Consulting with a law firm who is familiar with the laws in the State of Florida brings with it "peace of mind." At Cox & Nici, we are your advocate. We will represent only your interests in the buying and/or selling of a home or property and will protect you from a variety of potential problems that may range from annoying to extremely costly. Every negotiation for the sale or purchase of a home is different and consulting an attorney in the beginning can help you get what you want out of the transaction. Since your contract is a legally binding document, you should always have the terms of your contract reviewed by your attorney prior to signing.

If you are purchasing a newly constructed home from a builder/contractor, you may have a unique set of legal issues. Construction contracts vary in their complexity and most are written by the builders' attorney to protect the builders' interest. We can help you negotiate and also provide assistance if disputes arise. It is also essential in purchasing new construction to ensure that all subcontractors have completed the work required before any money is released.

Another important aspect of a real estate transaction is obtaining a title search. A title search, a thorough history of the property, is essential to see if there are any outstanding liens or judgements, such as "back taxes." We examine title and pursue whatever legal remedies are needed to clear any and all title defects.

At closing, we take the time to explain each document being signed as well as the closing statement, which contains a list of credits and debits to each party's side of the balance sheet. We will also ensure that all documents relating to the title of the property, mortgage financing and the closing itself are correct and in order.
